USA: REFORMS WITH REGARD TO US TRADEMARKS AND COPYRIGHTS
The Congress has passed the Consolidated Appropriations Act on December 21, 2020.
Accordingly, the Act brings some alterations regarding trademark procedures which will be fundamental for trademark litigation and prosecution. Accordingly, seeking injunction has been eased and the availability of which is broadened.
Besides, some other procedures have been brought regarding expunging of marks which bear importance for the registered marks not being used by the trademark owners.
The new Act also brings new regulation for Copyrights. Correspondingly, a small claims tribunal has been created which is within the body of U.S. Copyright Office having an aim for rendering decisions as to disputes regarding infringement. In accordance with the new regulation, the small claims tribunal will have the competency to hear claims with a maximum recovery of USD 30,000.
