Morocco (population ~38.4 million, 2025 est.) is one of Africa’s most commercially significant markets and a regional platform for manufacturing and export.

Morocco is a signatory to most of the international IP treaties, including the Paris Convention,  Berne Convention TRIPS (WTO)Patent Cooperation Treaty (PCT), the Madrid, Hague and Nice Agreements,  among others.   Morocco has continued to modernize its framework—most notably through joining the Geneva Act of the Hague Agreement for international design registrations. 

The Moroccan Office of Industrial and Commercial Property (OMPIC) is the competent authority for industrial property rights in Morocco, including trademarks, patents, and industrial designs.

  • Term: 10 years from filing; renewable indefinitely for further 10-year periods.
  • International route: Morocco is a member of the Madrid System (international trademark registrations).
  • Priority: 6 months (Paris Convention).
  • Typical timeline: ~12–18 months if unopposed.
  • Opposition: 2 months from publication in the Official Bulletin.
  • Maintenance: No annuities—renewal every 10 years (with a 6-month grace period after expiry; surcharge applies).
  • Use / vulnerability: Non-use for 5 consecutive years may expose a mark to cancellation.

Practice note: In Morocco, oppositions and non-use vulnerabilities mean that a “quick filing” approach can create future friction. Getting the specification and class coverage right—and aligning filing strategy with how the brand will actually be used in commerce—reduces downstream risk.

  • Term: 20 years.
  • International route: Morocco is a PCT contracting state (national phase entry available).
  • Priority: 12 months (Paris Convention).
  • Formalities (typical): Applicant details; specification (description/claims/abstract); drawings if applicable; Power of Attorney (simply signed; no notarization/legalization typically required); priority document if claimed.
  • Maintenance fees: Annual annuities are payable starting from the filing date and must be paid each year to keep the patent in force.
  • Jurisdictional Note: Pharmaceutical product patent terms may be eligible for an extension (up to 2.5 years) in circumstances tied to marketing authorization timing.

  • Term: 5 years from filing; renewable twice for additional 5-year periods (maximum 15 years).
  • International route: Morocco is a member of the Hague System (Geneva Act), allowing design protection to be structured internationally through a single filing strategy where appropriate.
  • Typical timeline: Commonly 6–12 months; generally no substantive examination.
  • Maintenance: No annual fees—renewal fees are due every 5 years (with a 6-month grace period after expiry; surcharge applies).

  • Protection: Copyright arises automatically upon creation; registration is optional and typically used for evidentiary support.
  • Filing (if pursued): Application form with author details, a copy/representation of the work, and official fee.
  • Morocco-specific point: Moroccan law recognizes protection for folklore and national cultural heritage, which cannot be freely appropriated or registered by private parties.
