Oman Trademark Office Tightens Requirements for Filing Trademark Oppositions
The Omani Trademark Office, operating under the Ministry of Commerce, Industry and Investment Promotion (MoCIIP), has adopted a stricter approach to the legal standing required to file trademark oppositions.
Under the current practice, an opposition to a published trademark application must be supported by an existing trademark registration or pending trademark application in Oman covering the relevant class.
This development is particularly important for international brand owners that may previously have sought to rely on factors such as well-known trademark status, international registrations or prior use when challenging potentially conflicting marks in Oman.
What Is Required to File an Opposition?
To establish the required standing, the opposing party must hold either:
- a registered trademark in Oman; or
- a pending trademark application in Oman covering the relevant class.
Where a brand owner does not have an existing Omani registration or application when a conflicting mark is published, it may be necessary to file a new trademark application for the relevant mark and class concurrently with the opposition. This filing can provide the necessary basis for the opposition to proceed.
Where the opposing party cannot demonstrate an Omani registration or corresponding pending application, the Trademark Office may decline to accept the opposition or proceed with its examination.
